All development projects are governed by a separate project agreement or statement of work (SOW) that outlines scope, timeline, deliverables, and payment terms. In the event of any conflict between these Terms and a signed project agreement, the project agreement takes precedence.
Clients are responsible for providing accurate project requirements, timely feedback, necessary content and assets, and timely payments as agreed in the project contract.
Upon full payment for a project, ownership of the final deliverables (website, application, software) transfers to the client as specified in the project agreement. Moogle Infotech retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
All pre-existing tools, frameworks, libraries, and proprietary methodologies used by Moogle Infotech remain our intellectual property.
Payment terms are defined in individual project agreements. Unless otherwise stated:
Moogle Infotech warrants that services will be performed with reasonable skill and care. We provide a limited warranty period for bug fixes on delivered projects as specified in the project agreement.
Our website and general service descriptions are provided "as is" without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted or error-free.
To the maximum extent permitted by law, Moogle Infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. This obligation survives the termination of any project agreement.
Either party may terminate a project agreement as specified in the contract. Moogle Infotech reserves the right to suspend or terminate access to our website for users who violate these Terms.
Our projects may integrate third-party services (hosting, payment gateways, APIs, etc.). We are not responsible for the availability, performance, or policies of third-party services. Clients are responsible for maintaining their own accounts and subscriptions with third-party providers where applicable.
These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh, India.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our website after changes constitutes acceptance of the updated Terms.
